Terms of Service

The plain-English summary of each section is binding intent; the full executed agreement is provided at account opening.

DRAFT — PENDING LEGAL REVIEW

1. Who we are and what this covers

These terms govern your use of the MonetisePay website and platform — digital-asset custody and spot exchange services. By opening an account you agree to them; the countersigned account agreement provided at onboarding is the complete, controlling document.

2. Eligibility

You must be of legal age in your jurisdiction, pass identity verification, and not be located in, or acting on behalf of a person in, a jurisdiction or on a sanctions list we are prohibited from serving. We may decline or close accounts to meet these obligations.

3. Your account

You are responsible for safeguarding your credentials and second factor, and for all activity performed with them. Tell us immediately at security@monetisepay.com if you suspect compromise. Security features we provide (2FA, allowlists, alerts) only protect you if you use them.

4. Custody of assets

Customer assets are held segregated from company assets, in wallets individually attributed to you, per our published custody architecture. We do not lend, stake, pledge or otherwise use customer assets. Crypto-assets are not deposits and are not covered by deposit-guarantee schemes.

5. Trading

The exchange offers spot trading only, settled against credited custody balances. Orders, once matched, are final. Fees are per the published schedule provided before you first trade; changes are notified in advance.

6. Deposits and withdrawals

Deposits are credited after the required network confirmations. Withdrawals are subject to security checks, allowlists where configured, velocity limits and approval workflows, and may be delayed or declined where checks fail or legal obligations require.

7. Prohibited use

No money laundering, sanctions evasion, fraud, market manipulation (including wash trading and spoofing), unauthorised access attempts, or use on behalf of unverified third parties. Violations lead to account closure and, where required, reports to authorities.

8. Risk acknowledgement

You confirm you have read and understood the Risk Disclosure, and that you can bear total loss of amounts committed. Nothing on this platform is investment advice.

9. Service availability and changes

We aim for continuous availability but do not guarantee it; maintenance, incidents and fail-closed security halts can interrupt service. We may amend features and these terms with notice; continued use after notice is acceptance.

10. Liability

To the extent permitted by law, we are not liable for losses from market movements, network-level events (forks, reorganisations, congestion), your credential compromise, or force majeure. Nothing excludes liability that cannot lawfully be excluded, including for fraud on our part.

11. Termination

You may close your account at any time after withdrawing balances. We may suspend or terminate for breach, legal necessity or risk grounds — in which case lawful return of your assets remains the objective and the obligation.

12. Governing law and disputes

Governing law, jurisdiction and the complaints process are stated in your account agreement. Contact support@monetisepay.com first — most disputes are resolved by a human reading them carefully.

Risk warning: Crypto-assets are highly volatile and you can lose everything you put in. They are not covered by government deposit-protection schemes. Never invest money you cannot afford to lose. Read our full risk disclosure.
